Privacy Policy

Online Restaurant Manager is a full-service online management and marketing tool that allows restaurant owners and managers to compile and monitor tracking data from various third party sources into a single dashboard for a more streamline analysis of customer reviews, comments complaints and social media communication.  

This “Privacy Policy” governs your use of any online service location that posts a link to this Privacy Policy (each a “Site”) (including, without limitation, both mobile and online versions), and also applies to your use of interactive features, widgets, plug-ins, applications, content, downloads and/or other services that we own and control and make available through a Site (collectively, the “Services”), regardless of how you access or use them, whether via personal computers, mobile devices or otherwise, but does not apply to data we receive from third parties, even if they use our technology to collect it, unless we combine such data with Personal Information (defined below) that we have ourselves collected under this Privacy Policy. This Privacy Policy does not apply to our data collection activities offline or otherwise outside of our Service (unless otherwise stated below), and does not govern the data practices of third parties that may interact with our Service.  

Please review our Terms of Service, which governs your use of Online Restaurant Manager.  By using Online Restaurant Manager, you consent to our Privacy Policy, and agree to be bound and abide by our Terms of Service.  If you do not agree with any term in this Privacy Policy, please do not use this Site or provide us with any Personal Information.

What Information Do We Collect

We may request that you enter certain personal information in order to provide and improve our Service. We will collect only the minimum amount of information required to facilitate the Services; however, we provide you with the option of sharing additional information to enhance your use of the Site. Online Restaurant Manager does not knowingly or intentionally collect Personal Information from individuals who are under the age of thirteen (13).  

“Personal Information” means information about an identifiable individual, such as a person’s name, email address, residential address, telephone number, and in some cases, more sensitive information including, but not limited to, demographic information, or partial credit card information.  

We do not collect or store full credit card or bank information. All transactions are processed by a third party payment processor.  

In addition to Personal Information (as defined above), we may collect the following categories of information from or about you through your use of our Service, including but not limited to:

Third Party Credentials – You may be asked to enter in certain passwords, usernames, account numbers, and other account information for third party sites and Internet services (“Third Party Sites”).  It should be noted that Online Restaurant Manager does not store these credentials; rather, we are able to access them through a token mechanism which you can revoke at any time through the Site.

Information from Third Party Sites – In order to display information to you through the online management dashboard, we may collect, on your behalf, your account and other personal information from Third Party Sites that you register under your account via the Service.  For example, if you register your Google Analytics account with us, we will aggregate your Google Analytics data via our Site in order to present it to you.  Any Personal Information compiled from Third Party Sites for use in connection with our Services will be treated as Personal Information under this Privacy Policy and our Terms of Use.

Domain Name – Our service provides the option to use a free domain name.  However, if you choose to provide a domain name of your choice, we may request the domain registration information which may include the Personal Information of the registrant.

Surveys and Promotions – From time to time, you may be offered an opportunity to participate in a contest, survey, or other promotion.  We may collect or you may submit information in connection with one of these promotions.

Technical and Navigational Information:  We collect information about your interaction with our Site, such as computer browser type, pages visited, average time spent on our Site, IP address, unique identifier of the device, operating system version and app version.

Location Information – If you choose to use a location-enabled Service, we may collect location information from your device and will notify you of this collection.  You may control or disable the sharing of location information via your device setting and/or under the Site.

Other Information – We may request or receive other information, such as feedback, questions, comments, suggestions, or ideas to provide you with other benefits or to improve upon the Service.  In such instances, you will be given the opportunity to provide or decline that information.

How We May Use or Disclose Your Personal Information

We collect, use, and disclose Personal Information only for the purposes of providing you with our Services and for such other ancillary purposes consented to by you as user of Online Restaurant Manager.  Personal Information may be accessed and stored, pursuant to your implied consent, but it will not be sold, shared, or distributed to any third party absent your express consent.

More specifically, Online Restaurant Manager collects, uses, and discloses information (which may include Personal Information) for the following purposes:

To provide you with our Services, including to fulfill your requests or to respond to your inquiries about our Site or Services.  

To promote or offer you products, services and offers (including new and other Services that are offered by us, our sponsors and partners) that may be relevant to you and your business.  When you are using our Service you may be provided with relevant opportunities and related links based on information related to your use of the Service. We will never share your Personal Information with a third party absent your express consent.

To contact you for purposes of product information, service updates, notifications relating to the Services, and newsletters or promotional opportunities.  At any time, Online Restaurant Manager users can opt-out of most email communication by clicking “unsubscribe” at the bottom of the emails received.

To monitor system usage and performance, to improve system design, create promotional materials, create benchmarks, develop case studies and to conduct trending analyses.

To assist with technical support issues. It is important to remember that most technical issues can be resolved without viewing your Personal Information.

To comply with any laws, regulations, court orders, subpoenas or other legal process or investigation, and to protect ourselves and other individuals from harm.

To assist in due diligence relating to any corporate action, such as a financing, merger, sale or divestiture, provided that reasonable safeguards are taken to protect the confidentiality of Personal Information in our possession.  You will be notified via email and/or a prominent notice on our Site of any change in corporate ownership.

Opt-Out Procedure

We collect Personal Information directly from you and only obtain Personal Information from other entities (e.g. third-party service providers) when you provide us with the account numbers, passwords, or other credentials required to retrieve and aggregate your data for the purpose of providing you with our Services.

You may always choose not to provide any Personal Information through the Site, in which case we may not be able to provide Services to you. At any time, Online Restaurant Manager users can close their account by contacting us at info@onlinerestaurantmanager.com

If you opt out of third party services, but retain our website hosting service the Privacy Policy and Terms of Service will remain in effect.

If you chose to completely close your Online Restaurant Manager account, you may request in writing that the User Content you provided be transferred to a new hosting service according to Best Practices {LINK} governing the transfer of service.  Opting-out in this manner means that you must discontinue all use of the Service.

Third Party Sites

Online Restaurant Manager may use or contain content that is supplied by a third party, and those Third Party Sites may collect Personal Information and other data in connection with your use of our Site and theirs.  In addition, when you are using Online Restaurant Manager, you may be directed to other services that are operated and owned by third parties that we do not control.  We are not responsible for the data collection and privacy practices employed by any of these Third Party Sites.  You are responsible for reviewing and agreeing to the respective terms of use and privacy policy of each Third Party Site that you use in connection with our Service; these are separate agreements. If you do not agree with the terms and policies, you should not use the services offered by that Third Party Site.

Cookies and Other Tracking Technologies

As is true of most websites, to help operate the Site, enhance your experience, and collect information about online activity, we may place small data files on your computer or mobile device.  This information may include, but is not limited to, internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and/or clickstream data.  These data files may be in the form of cookies, pixel tags, local shared objects, or other similar technologies.

Cookies and similar technologies, enable us to personalize our Site and Service for you.  These technologies may allow us to store and manage your preferences and settings, to measure and analyze how you use our Site and the effectiveness of our communications, to offer targeted products, programs, and services, and to help us improve Online Restaurant Manager’s overall functionality.   

Data Security

We offer cloud-based services and retain all Personal Information provided by you, on secure remote servers protected by protocols and procedures designed to ensure the security of such information. In addition, we restrict access to Personal Information to our employees, and independent contractors who need to know this information. However, no server, computer or communications network can be guaranteed to be 100% secure.  Accordingly, we cannot warrant the security of any information you transmit to us through the Service and you acknowledge and agree that you provide such information at your own risk.

Notification of Privacy Policy Changes

We reserve the right to change this Privacy Policy at any time.  Any changes will be effective immediately upon the posting of the revised Privacy Policy and your continued use of Online Restaurant Manager indicates your consent to the privacy policy posted at that time.  We will not, however, use your previously collected Personal Information in a manner materially different than represented at the time it was collected without your consent.  If we make any material changes we will notify you by email (sent to the email address specified in your account) or by means of a notice on our website prior to the change becoming effective.  We encourage you to periodically review our Privacy Policy for the latest information on our privacy practices.

To the extent any provision of this Privacy Policy is found by a competent tribunal to be invalid or unenforceable, such provision shall be severed to the extent necessary for the remainder to be valid and enforceable.
